It is important for businesses, or persons conducting a business or undertaking (PCBU), to understand their obligations under the Work Health and Safety Act 2012 (SA).

The primary duty of a PCBU is to ensure, so far as reasonably practicable, the health and safety of workers while at work, as well as “other persons” (i.e. visitors).  A failure to comply with these duties can result in prosecutions and significant fines. Officers of a business (i.e. directors and managers) have an additional duty to exercise due diligence to ensure that the PCBU complies with its duties. This includes keeping up to date with work, health and safety requirements.

There are additional duties that apply to PCBUs who: manage or control a workplace; manage or control fixtures, fittings or plant; design, manufacture, import or supply plant, substances or structures; or install, construct or commission plant or structures.

We can assist with the following:

  • Helping you to understand your work, health and safety obligations and put in place measures to reduce the risk of non-compliance, or an incident occurring;
  • Reviewing and updating workplace policies, procedures, safe work method statements and supporting documentation;
  • Training for supervisors, safety personnel and employees;
  • Helping you to comply with Prohibition and Improvement Notices issued by SafeWork SA;
  • Helping you to understand your obligations in respect of notification of incidents, and requirements under Regulations, Standards and Codes of Practice;
  • Incident management, including corresponding with SafeWork SA Inspectors and attending on-site following an incident; and
  • Responding to prosecutions and arranging for suitable representation in the South Australian Employment Tribunal.
