It is important for businesses, or persons conducting a business or undertaking (PCBU), to understand their obligations under the Work Health and Safety Act 2012 (SA).
The primary duty of a PCBU is to ensure, so far as reasonably practicable, the health and safety of workers while at work, as well as “other persons” (i.e. visitors). A failure to comply with these duties can result in prosecutions and significant fines. Officers of a business (i.e. directors and managers) have an additional duty to exercise due diligence to ensure that the PCBU complies with its duties. This includes keeping up to date with work, health and safety requirements.
There are additional duties that apply to PCBUs who: manage or control a workplace; manage or control fixtures, fittings or plant; design, manufacture, import or supply plant, substances or structures; or install, construct or commission plant or structures.
