Tom Grace, partner in Fenwick Elliott Grace, will present an update on several important decisions delivered in April and May of 2018.
The Act has become widely used over the last few years in the construction industry as a means of ensuring progress payments are made on time. The Act imposes a strict timeframe for dealing with disputed payments and accordingly has been said by some to impose a “rough and ready” justice.
On 21 May 2018, the Federal Government released the Review of Security of Payment Laws by John Murray AM. Tom will cover some of the main points arising from this review.
Determinations are often made by non-lawyers and then challenged in Court by lawyers for errors of law. The High Court has recently considered the circumstances in which such challenges might succeed in Maxcon v Vadasz and Probuild Constructions v Shade Systems. Maxcon was a dispute arising out of an Adelaide apartment building.
In South Australia, the Supreme Court’s decision in Westside Mechanical v R&D Airconditioning considered the issue of claims made after termination of a contract. The court considered whether the reference date for claims exists outside of the contract terms, and whether an adjudication determination applied for in respect of an invalid reference date can be upheld on the basis of an alternative valid reference date. Similar issues arose in NSW in Primelime (NSW) Pty Ltd v BAEC Contracting Pty Ltd.
These important issues have the potential to impact on future adjudications. If parties consider these issues when drafting their payment claims and payment schedules, they should improve their chances of avoiding disputes.

In August 2016, a 17 year-old apprentice was tragically killed when he was struck by a falling wall frame at a residential building site in Fullarton. The South Australian Employment Court has recently handed down its penalty decision, following a prosecution by SafeWork SA.
The Seminar will analyse the decision and educate industry participants to help minimise the risk of further incidents of this kind from occurring. The seminar will cover the following topics:
